A Warsaw man was arrested after allegedly taking photos of customers of a business in the bathroom.
Kaleb Michael Sumpter, 22, of 2835 E. Lake Tahoe Trail, Warsaw, is charged with two counts of possession of child pornography, a level 5 felony; and voyeurism, a class A misdemeanor.
He was booked into the Kosciusko County Jail at 5:39 p.m. May 4 on a $10,250 preliminary bond. There was no booking photo available.
According to the probable cause affidavit, on April 5 Kosciusko County Dispatch advised law enforcement about a man taking photos at a business in the men’s bathroom under the stalls.
A Warsaw Police Department officer arrived at the scene and located the man, later identified as Sumpter, still in the business’ bathroom. The officer read Sumpter his Miranda rights. The officer talked with Sumpter who said he took a photograph of himself in the bathroom and sent it to a friend.
The officer spoke with the business’ manager who said he was in the bathroom, pretended to clean the mirrors and saw Sumpter in the bathroom stall. The manager saw Sumpter put his phone on the ground, point the camera where a customer was in the next stall and Sumpter held the phone for 15 to 30 seconds. The manager took a photo of Sumpter pointing his phone at the customer.
The officer reviewed the photo provided by the manager, which showed a hand that was holding a cell phone on its side down below the stall. The officer located a tattoo of a cat’s face on the back of the hand. Sumpter admitted that was his hand.
On April 17, a search warrant was obtained to complete a forensic download of Sumpter’s cell phone. Officers located multiple videos and photography of men within the same business’ bathroom that were using the urinals and within the stalls. One photo involved a juvenile.
On April 28, a search warrant was obtained to complete a forensic download on Sumpter’s cell phone that included the crime of possession of child pornography within its scope. An officer located 361 images taken in the same business’ bathroom and the victims were unaware. Some of the photographs showed exposed genitalia of some men.
An officer also located 1,024 videos that appeared to be child pornography.
On May 4, an officer spoke with Sumpter and he agreed to talk to law enforcement officers. Sumpter admitted he recorded people as they used the business’ bathroom and he only did this at one business.
Sumpter said he unsuspectingly received child photography through an application and he moved the child pornography to his “hidden” photograph folder. Sumpter said he only viewed a few of the child pornography videos and he did not know how to delete the content from the application.
