NOBLE COUNTY - A traffic stop late Friday night led to the arrest of Kosciusko County Councilwoman Kimberly Cates for operating a vehicle while intoxicated with a prior.
According to the probable cause affidavit filed Monday, Sept. 28 in Noble County Superior Court Division I, at 10:09 p.m. Friday, Sept. 25 an officer with the Albion Police Department observed a 2014 white Audi A6 with expired plates at the intersection of Main and Oak streets in Albion. Cates, 62, of 12361 N. Kings Drive, Syracuse, was seated in the driver’s seat when the vehicle was pulled over.
The officer had reason to believe Cates was intoxicated because the officer detected the odor of alcoholic beverage, her eyes were glassy and red, her balance was unsteady and she had bloodshot eyes. She failed two of the three field tests, the walk and turn and the one-leg stand.
The officer advised Cates of the Implied Consent Law and Cates refused a chemical test, according to the affidavit. A warrant was obtained and a sample of Cates’ blood was drawn at 1:03 a.m. Saturday, Sept. 26.
Cates was booked into the Noble County Jail at 1:45 a.m. Saturday, Sept. 26 on a charge of operating a motor vehicle while intoxicated with a prior conviction within seven years, a level 6 felony.
She was previously convicted of operating a vehicle while intoxicated endangering a person on Aug. 30, 2024, in Kosciusko County.
