MILFORD – A driver says failed brakes are to blame for an accident that injured two Friday morning, according to a report from the Milford Police Department.
Robert Nichter, 40, Old 15, Warsaw, told police the brakes on the Lowe’s delivery truck he was driving failed, causing him to collide with a truck at the intersection of Main and Syracuse streets, Milford, at 10:44 a.m Friday.
Nichter said he attempted to apply the emergency brake, but was too late to avoid the collision, the report states.
He told the police he had no issues with that truck in the past.
Milford Town Marshal Travis Marsh said an investigator from the Indiana State Police has not yet examined the vehicle to check the brakes.
Lowe’s also will be performing its own investigation of the truck, Marsh said.
Leon Garrett, 72, James Street, Milford, was airlifted to South Bend Memorial Hospital after the truck he was driving was hit by Nichter’s vehicle.
Garrett was unresponsive at the scene. As of Friday evening, he was listed in stable condition.
Kevin Kennedy, 50, James Street, Milford, a passenger in Garrett’s truck, also was taken to the hospital with minor injuries.
