ALBION - Kosciusko County Councilwoman Kimberly Cates’ petition for an ignition interlock device was denied Friday, Oct. 2 in Noble County Superior Court I.
Cates was arrested in Noble County Friday, Sept. 25 for operating a motor vehicle while intoxicated with a prior conviction, a level 6 felony.
In a petition filed Tuesday, Sept. 29, Cates, along with her attorney, Scott Reust, asked the court to allow an ignition interlock device to be installed in lieu of suspending Cates’ driving privileges.
According to court documents, suspending Cates’ driving privileges would “cause a substantial hardship as she must drive to and from employment and family commitments on a daily basis.”
Noble County Deputy Prosecuting Attorney Natalie N. Coffey filed a notice with the court Friday, Oct. 2, asking the court to deny the motion for an ignition interlock device. Coffey cited Cates’ previous criminal history, BMV record and “other relevant documentation,” as well as Cates’ refusal to submit to implied consent testing and the current OWI charge with a prior conviction.
On Friday, Oct. 2, Noble County Superior Court Judge Wendy Davis denied Cates’ motion for an ignition interlock device in lieu of suspension of her driving privileges.
