Article V Expansion

Just as the states have the power in Article V of the Constitution to ratify constitutional amendments by a three-fourths majority (38) of their number, so should the states have the to repeal federal acts, laws and rulings upon a three-fourths majority of their number. The following below is a proposed constitutional amendment for effecting such a change.

Proposed Article V Amendment Allowing States To Repeal

The states as a whole shall have the authority to repeal by a three-fourths majority (38) or more of their number any part or whole of an executive order signed by the president, a legislative act passed by Congress, a Supreme Court ruling, an international treaty ratified by the Senate or regulations issued by a federal bureaucratic agency, and the enforcement by the federal government of any decree, before or after the ratification of this amendment unless such an act of veto infringes upon the natural and constitutional rights of the citizens and inhabitants of the United States and its territories. Such an act of repeal must be approved by a two-thirds majority of each individual state legislature and can only be rescinded in that legislature by a two-thirds majority.

The act of repeal should be in the form of a constitutional amendment which would ensure that is not done for transient or frivolous reasons. An additional avenue for proposing these amendments to be proposed directly in the state legislatures where it would need a 2/3 majority vote in order to pass in each state legislature and a total of 3/4 of the legislatures in the Union would have to approve a uniform amendment in the end. This would allow an easier avenue for the states than calling an Article V convention or going the normally used route of proposing constitutional amendments in Congress. Even though a limited number of repeal amendments would pass, they would still have a dampening effect on any unconstitutional act or abuses of power by any branch of the federal government.

Please contact your U.S. Representatives and U.S. Senators and urge adoption of the above measures. This amendment and expansion of Article V may need to be adopted by a convention of the states if it cannot be passed in Congress
