Warsaw Man Found Guilty Of Residential Entry, Marijuana Possession

A Warsaw man was found guilty of entering a residence without permission.
During a jury trial in Kosciusko Superior Court III on Tuesday, June 16, Benjamin Neal Jones, 41, of 3636 S. Bruner Road, Warsaw, was found guilty of residential entry, a level 6 felony; and possession of marijuana, a class B misdemeanor. He was found not guilty of domestic battery, a level 6 felony.
The state's case was presented by Chief Deputy Prosecuting Attorney Dan Hampton. Brian Pyle was Jones' defense counsel.
Sentencing for Jones is scheduled for 10 a.m. July 14. Following the verdict, Jones was remanded to the custody of the Kosciusko County Sheriff.
Affidavit Of Probable Cause
On Nov. 22, 2025, Kosciusko County dispatch advised officers about an unwanted subject at a Warsaw residence.
According to court documents, the victim told officers they were at home when they heard someone knock on the door and crack it open. When the victim placed their foot behind the door, Jones forced it open and entered the home without the victim's permission.
While speaking to Jones inside his vehicle, officers found a bag containing marijuana. Jones denied forcing his way into his home and said he was invited in by the victim.
A witness who was at the victim's home all day said Jones knocked on the door and then pushed his way into the residence.
