Samuel Davis Jr., 44, of 422 Sophie Lane, Warsaw, was taken into custody at 12:26 a.m. Wednesday for operating a vehicle while intoxicated, felony probation violation and sexual battery.
According to a probable cause affidavit, Warsaw police officers responded to a report of sexual battery that included unwanted touching and continued harassment.
The victim reported she was at a house with her boyfriend, a minor child and Davis when Davis began using his foot to rub her legs, thigh and touch her genitalia on the outside of her clothing. He refused to stop after repeated requests for him to do so, according to the filing.
The victim then said she went to the gas station, using Davis' car, and Davis wouldn't let her borrow the car unless he went along. The victim told police she asked the minor child to go along for her protection. At the gas station, Davis and the victim obtained their items and the minor was still in the gas station when Davis and the victim returned to the car. Davis then used his hand to continue to touch her and talk sexually to her.
He is also facing charges for OWI and probation violation.
