A Warsaw man was arrested Friday after allegedly threatening police and hospital personnel in January.

Benson Ray Netherland, 44, of 611 E. Market St., Warsaw, was arrested and booked into the Kosciusko County Jail at 7:48 p.m. Friday on charges of intimidation and resisting law enforcement.

Court documents filed Jan. 18 list the counts against him as intimidation, a level 6 felony, and resisting law enforcement, a Class A misdemeanor.

On Jan. 11, Warsaw Police Officer Jacob Metzger responded to a report of an unconscious person at house at 611 E. Market St., and found Netherland unconscious on the living room floor, having a difficult time breathing and foaming at the mouth.

As officers assisted Benson to his feet, he pulled his arms away and attempted to break free, court documents state. Due to the level of Benson’s intoxication, he was taken by ambulance to Kosciusko Community Hospital.

Once inside the hospital, Benson refused to cooperate with the staff. Metzger informed Benson he needed to sit down, but Benson refused and said he was going to fight. He said he might not win but he was going to hurt a few people.

Officers then restrained him on a bed. Benson continued to resist and used his left leg to try and kick WPD officer Allen Danko. Danko told Benson to stop before he got himself into trouble. Benson replied, “I will kill you.”

Benson then looked at each officer in the room and said, “I will kill you,” according to court documents.

Benson also threatened to choke a medic to death, paperwork said.

Benson’s bond was set at $500 surety and $250 cash.
