A Warsaw man was arrested after allegedly inappropriately touching a child and providing alcohol to two children.
Shane Matthew Witmer, 42, of 7875 W. Lovetts Court, Warsaw, is charged with sexual misconduct with a minor, a level 5 felony; and contributing to the delinquency of a minor, a class A misdemeanor.
He was booked into the Kosciusko County Jail at 12:05 p.m. Monday on a $27,500 preliminary bond.
According to the probable cause affidavit, on April 5, 2025, Kosciusko County Central Dispatch advised law enforcement of an alleged sexual assault and the suspect was Witmer. Kosciusko County Sheriff’s Office deputies responded.
A deputy spoke with a woman who said a child told her the child had woken up with their onesie unzipped and Witmer had his hands on the child’s private areas. The deputy saw the child, who appeared in distress and was crying, according to court documents. The child said Witmer provided them alcohol.
A detective arrived to the scene and learned another child was inside the house. The detective located the second child passed out from alcohol intoxication in a bedroom and the second child said Witmer gave them alcohol.
On April 10, 2025, the first child was forensically interviewed at the Safe Harbor Child Advocacy Center. The child said on April 1, 2025, they and the second child drank alcohol Witmer provided. The two children wore matching onesies. The first child indicated they vomited, went downstairs to lay down and they slept or blacked out with their onesie on with the zipper zipped up.
The first child said sometime during the night on April 2, 2025, they woke up and Witmer was rubbing them. The child noted the zipper on their onesie was down. The child said they rolled onto their stomach and Witmer nudged the child to roll back on their side. The child told Witmer they needed to vomit and left the room.
The first child saw the second child and told them what happened.
On April 16, 2025, Witmer took a polygraph. The result of the examination determined there was deception indicated. Witmer was not truthful when he answered “no” when he was asked if he had touched the first child in a sexual matter, as well as when he answered “no” when he was asked if he touched the first child in a sexual manner inside the house.
