A Warsaw man who was previously convicted of domestic battery was arrested Thursday for allegedly battering the same victim again.

Billy Joe Truex, 34, of 504 W. Center St., Warsaw, was booked into the Kosciusko County Jail at 1:09 p.m. Thursday for domestic battery in the presence of a child under 16 and invasion of privacy. His preliminary bond was set at $21,750.

Court documents filed April 16 list charges against Truex as domestic battery with a child under 16 present, a level 6 felony; and domestic battery, a Class A misdemeanor, with an enhancement because of a prior conviction making it a level 5 felony.

Truex was convicted of domestic battery against the same victim on Oct. 13, 2016, in Kosciusko County.

On April 1, Warsaw Police Department officer Chuck Hodges spoke with a woman who said she was in the process of getting a divorce from Truex. She said that on March 30, Truex began arguing with her about not paying attention to him. He continued to argue with her and accused her of things that she had not done.

On April 1, Truex continued to accuse the victim of things, arguing with her and wanted to see her phone. She refused to give him her phone, he grabbed her by the neck, shoved her into the closet, threw her on the bed where a child was laying, court documents state. The child began crying.

Truex grabbed the victim again and threw her to the floor, pinning her down and taking her phone. The victim told the child to call 911, but Truex grabbed the child’s phone and the child began crying again.

Truex then begged the victim not to call the police. She went outside, where Truex threw her up against the apartment building, causing vehicles to stop on Center Street, according to court documents.
