Two Warsaw brothers were arrested Christmas eve for intimidation with a deadly weapon.
Frederick Joseph Erwin, 54, and Faron E. Erwin, 39, both of 707 E. Center St., #10, Warsaw, were arrested Dec. 24. Frederick’s bond was set at $2,550, and Faron’s bond was set at $5,250.
According to court documents filed Dec. 29, on Dec. 24 a Warsaw Police officer responded to an intimidation with weapons call in the Combined Community Services parking lot. Upon arrival, the officer spoke with Nicholas Phillips, who said he and his girlfriend, Autum Estep, went to the residence of her mother, Laura Estep.
Phillips said after entering the residence, Laura became upset with Phillips and wanted him to leave, grabbed him by his coat and shoved him outside.
He and Autum waited outside for about 10 minutes and then the Erwin brothers arrived, the documents state.
Frederick exited the vehicle carrying a baseball bat and Faron had a silver semi-automatic handgun. The brothers yelled at Phillips to leave. Faron allegedly held the handgun sideways pointed at Phillips’ face and told him, “I’ll (expletive) kill you.” Phillips feared for his life, got into his vehicle and left the area, the documents state.
The officer spoke with Autum who said she and Phillips went to her mother’s residence and Laura was upset. At the home, Phillips called her brothers, Faron and Frederick, to come to the residence. Autum repeated the same story Phillips offered.
Court documents state Faron told the investigating officer that Frederick had a baseball bat but didn’t hit anyone. Faron said he had an unloaded gun but did not point it at Phillips.
Officers then arrested Faron and searched him, finding an unloaded Smith & Wesson handgun in his waistband.
Frederick gave police permission to get the wooden baseball bat out of the vehicle.
Faron did not have a permit to carry a handgun in Indiana, the court documents state.
