North Webster man faces charges of having sex with a minorA North Webster man was arrested on three counts of sexual misconduct with a minor after she became pregnant.

David Edward Killian, 69, Bristol, was arrested and booked into the Kosciusko County Jail at 12:20 p.m. Thursday with a preliminary bond set at $25,250. Court documents filed list charges against him as two counts of sexual misconduct with a minor, level 5 felonies, and one count of sexual misconduct with a minor, a level 4 felony.

The court documents also list his address as North Webster.

On Aug. 10, North Webster Police officer Candace Smythe spoke with a girl who was at least 14 but less than 16 years old, who told Smythe that Killian had touched her inappropriately.

Child Protective Services caseworker Nicole Nabinger and Smythe spoke with the girl who said Killian had been touching her inappropriately since March 2017. She said the incidences occurred at 312 W. Crystal Flash Road, lot 26.



 


She said the first time it occurred it was in March 2017 and she and Killian were on the couch. He grabbed her breast and tried to touch her genitalia on top of her clothing. She told him no but he kept trying.

Sometime between March and August 2017, she said Killian put his hands between her legs and rubbed above her clothes. He then pinned her to the couch and attempted to have sex with her. She told him to stop or she would tell. Killian then stopped and called her names.

On another occasion, she said Killian told her he would give her money in exchange for sex. She said they had sex, the report said.

She said the last time the incidents occurred was in the first part of August 2017. Killian came up behind her and grabbed her breasts over her clothing. She said she was scared and feels very uncomfortable when Killian is around.

In December, NWPD officer David S. May learned the girl was 71⁄2 months pregnant. She eventually gave birth.

As a result of DNA tests, the Indiana State Police Lab determined that Killian was 99.9999 percent likely to be the father of the child.
