A civil lawsuit was filed against the owner and resident of a Milford property for allegedly failing to comply with an order with the Kosciusko County Health Department.
KCHD filed the suit against Sherlock Family R.E. Inc. and Whitney Schwab. The residential property involved in the suit is at 406 Turkey Creek Drive. Sherlock Family is listed as the property’s owner, while Schwab is listed as the resident.
According to the complaint, on Oct. 13 the health department served an order to vacate upon Schwab and Sherlock Family R.E. Inc. due to unsanitary conditions likely to cause sickness, general filth, garbage, pests and feces, “which not only renders the said dwelling uninhabitable and also poses a significant health risk to neighboring homes.”
As of Jan. 7, the residence was occupied, according to the complaint.
Schwab sent a letter to the court filed Jan. 30 stating the allegations are false. Work is ongoing to repair the residence. She said no one is living at the residence.
