Hearing Officer Gives Center St. Property More Time For Repairs

A property on Center Street that’s been on the city’s code enforcement docket for months was given more time to get up to snuff.

Alan Kado, of Elkhart, appeared once again in front of hearing officer Tom Earhart Tuesday to provide updates on his property at 704 E. Center St., Warsaw, along with his attorney, Travis McConnell.

Kado was served with a lengthy list of repairs that needed to be made, and just on Monday did the health department lift a condemnation from two of the apartment units.

Earhart had threatened at the last meeting to move forward with a demolition order if Kado didn’t make more significant progress.

At the Tuesday hearing, building commissioner Ray Behling said Monday the health department, himself and the fire chief inspected the property and saw the work that’s been completed and is being done. That work included some new windows but the front porch is still being worked on.

Dana Hewitt, code enforcement inspector, said his biggest concern is the roof and a wall in one of the apartments is leaking water. Hewitt said it appears Kado put some wall paneling up to cover the water damage and that he wants to know what Kado plans to do to repair that water problem. Hewitt said the paneling needs to come down so they can inspect the problem.

McConnell said his client has contractors for the roof and that all work should be completed by February.

Another problem brought up for the property was that the furnace and water heater are inadequate for the square footage of the property, along with being only one thermostat to control all of the units.

“So if the person upstairs is cold, they can’t do anything about it except maybe try to talk to the person with the thermostat,” Behling said.

Kado was ordered to appear at the January meeting to provide a status update. That meeting is scheduled for 10 a.m. Jan. 12 at City Hall.
