Goshen Inmate Arrested After Allegedly Failing To Return To JailA Goshen man detained on a probation violation was arrested after failing to return to jail after a bereavement furlough.
Nick Charles Hunsberger II, 31, Goshen, is charged with escape, a Level 6 felony; and failure to return to lawful detention, a Level 6 felony.
He was booked into the Kosciusko County Jail at 11:28 a.m. Tuesday on a $60,000 preliminary bond.
According to the probable cause affidavit, on May 11, Hunsberger was in custody in the jail on a bond hold for a probation violation. On the same day, his lawyer filed a motion for a furlough to attend to matters in the death of Hunsberger’s 2-week-old daughter.
On May 12, Hunsberger’s bereavement furlough was granted and allowed him to post a $500 cash bond and be released on electronic GPS monitoring supervised by the Kosciusko County Community Corrections Program. The order also specified Hunsberger was subject to any rules the KCCC program deemed appropriate.
He was permitted to be at his residence only and at any funeral services for his child if he first get approval from his KCCC officer. Hunsberger also had to pay all electronic fees to KCCC. The furlough was to expire at noon May 27, where Hunsberger was to submit himself to the jail.
Hunsberger bonded out May 16 and placed on a GPS monitor by KCCC at about 10:40 a.m.
Subsequent to Hunsberger’s release, KCCC determined Hunsberger went to an unauthorized location. KCCC was also notified Hunsberger was not going to be allowed to reside at the approved residence after his child’s funeral.
On May 17, the court, having been told Hunsberger no longer had a qualifying residence in Kosciusko County to accommodate the furlough, amended the furlough to expire at 7 p.m. May 18. Hunsberger was made aware of the amended furlough order by a KCCC officer, according to court documents.
On May 18, KCCC got a call from Hunsberger saying he lost track of time and was just leaving the cemetery to report back to the jail.
Hunsberger was told by a KCCC officer that he needed to get his GPS monitoring beacon and battery and report to the jail immediately.
At 7:02 p.m. Hunsberger was located at an unauthorized location for 20 minutes. At 7:57 p.m., Hunsberger was located at the approved residence and retrieved his GPS monitoring beacon and battery. He left the location at 8:07 p.m. and began traveling in the direction of Warsaw. Hunsberger never returned to the jail until he was arrested Tuesday.
