A Warsaw man is facing a felony battery charge after he allegedly beat a man up over a fight about fireworks.

Alexander Glen Hurley, 19, of 2115 E. Hendricks St., Warsaw, was booked in the Kosciusko County Jail at 9:31 p.m. Wednesday and faces a Level 5 felony battery causing serious bodily injury charge.

According to the probable cause affidavit filed Aug. 3 in Kosciusko Superior Court III, on June 28 deputies with the Kosciusko County Sheriff’s Office responded to a battery report and upon arrival found a man sitting in the grass with a swollen eye and blood running down his face and a bloody nose.

Police spoke with the man who told them that he had a fight with a group of people who were setting off fireworks illegally in the Aegis Dental Group parking lot. The man told police he had spoken with the business’ owner earlier and the owner said no one had permission to be on the property.

A man who was part of the fireworks group took video of the fight, according to the affidavit. When police watched the video, the victim can be seen approaching the group and in an angry tone telling them they can’t be on the property. The victim then tried to punch the man filming, but missed.

After that, according to court papers, Hurley tackled the victim and pinned him to the ground, then punched him several times in the face.

The victim was initially taken to Kosciusko Community Hospital for treatment of his swelling and cuts. However, he then had to be transferred to Lutheran Hospital in Fort Wayne for serious injuries discovered at KCH.

Hurley’s bond was set at $3,000.
