Cromwell Man Faces Multiple Charges After Fleeing Police In AugustA probable cause affidavit filed Monday reveals a Cromwell man fled police on Aug. 27 because there was already a warrant out for his arrest.

Michael Alan Garman, 34, of 3757 N. CR 900W, #212, Cromwell, was arrested Aug. 28 for resisting (fleeing) law enforcement, resisting law enforcement with use of a vehicle, reckless driving, driving while suspended with a prior, misdemeanor possession of paraphernalia, a warrant for an Indiana agency, domestic battery in the presence of a child under 16 and felony failure to appear. No bond was set.

Information on the domestic battery charges against him were published in the Times-Union on Aug. 29. In part, it stated that on July 18, a North Webster police officer responded to a domestic dispute. Upon arrival, he spoke with the victim who said she and her boyfriend, Garman, were arguing when he became angry and shoved her hard, causing her pain. He left the house and shortly after called the victim, telling her, “I’m going to burn the house down with everyone inside of it.”





Court documents filed Monday list charges against Garman as resisting law enforcement, level 6 felony; resisting law enforcement, a Class A misdemeanor; reckless driving, a Class C misdemeanor; driving while suspended, a Class A misdemeanor; and possession of paraphernalia, a Class C misdemeanor.

On Aug. 27, Warsaw Police Department officer Sam Weaver saw a 1998 Chevy Blazer completely cross the centerline while traveling on CR 900N. Weaver used his vehicle’s lights to initiate a traffic stop. He made contact with the driver who failed  to produce a driver’s license but identified himself as Eric E. Garman with a birth date of Nov. 15, 1970. Weaver learned Garman gave him a false name and birthdate. When questioned about the fictitious information, Garman drove off, traveling west on CR 900N at 90 mph, according to court documents. After driving several miles and failing to stop at a stop sign, the vehicle left the road and went into a field. The vehicle was found but Garman fled on foot.

At about 7:09 a.m. Aug. 28, Weaver saw a man fitting the description of the person driving the Chevy Blazer the night before. He activated his lights and got out of his vehicle to confront the man but he ran off into a cornfield. He was apprehended by officers and identified as Michael Garman.

A records check indicated Garman has a suspended driver’s license.

Found on the ground where Garman entered the cornfield was a black glass smoking device containing a burnt residue and a cellphone, court documents state.

Garman said he fled law enforcement because he had an outstanding arrest warrant, and he apologized for fleeing.

His initial hearing is scheduled for 1 p.m. Oct. 18 in Kosciusko County Superior Court III.
