Claypool Woman Gets Three Years For Stabbing Ex-Husband In The HeadA Claypool woman was sentenced to three years Monday for stabbing her then-husband in the head with a knife.

Marcella Jane Dillon, 60, of 3019 W. Hill Lake Road, Claypool, appeared before Kosciusko Superior Court I Judge David Cates and was convicted to a Level 5 felony charge for domestic battery resulting in serious bodily injury. She was sentenced to three years in the Indiana Department of Corrections, with the option of serving her sentence through the Kosciusko County Community Corrections program, if she qualifies.

The case stems from almost two years ago to the day, when police were called to the Claypool home in regard to a domestic dispute. Neither Dillon nor her husband were cooperative with police at the time but said their dispute was only verbal. Kosciusko County Sheriff's Office deputies then responded a second time to the home and found the husband with a stab wound to the side of his head above his ear.

The man was taken to a Fort Wayne hospital because the knife punctured his skull.

In court Monday, Kosciusko County Chief Prosecuting Attorney Brad Voelz said he spoke with the victim and the victim didn’t have an opinion on how long Dillon should go to jail for, but did indicate he thinks she ought to serve something.

Voelz also told the judge that Dillon has a criminal history involving substances, violence and weapons.

Dillon’s attorney, David Kolbe, told Cates that while it’s not an excuse, his client and her former spouse have a toxic alcohol problem. Kolbe said the couple have since divorced and his client continues to run a successful business and lead a meaningful life, despite this two-year-old case. He added that Dillon also has taken responsibility.

“Your honor, I was in a horrible relationship, and I wish I would’ve gotten out before,” Dillon said Monday. “I truly loved my husband, I did. ... It was just like water and oil with me and him. ... I am sorry for what happened, and I just want to move on with my life.”

Cates said she does have a criminal history, and this conviction makes it the second felony on her record. He ordered her to have no contact with the victim and told her she’s not to leave the building without being hooked up to an ankle bracelet through KCCC, otherwise she’ll be headed to IDOC.
