Kosciusko County Board of Zoning Appeals was busy Tuesday morning hearing 15 petitions for variances or exceptions on properties, including one from Kosciusko County American Bikers Aimed Toward Education.
ABATE asked for permission to host its Hawg Waller event on property zoned agricultural on the northwest corner of CR 650W at CR 250N. The organization was required to re-petition the board because of complaints and violations from the previous event.
The petition was not approved for a lack of a majority, and it was suggested to ABATE that they attempt to find an alternate location which may be more conducive to their event.
The matter was continued to the May 7 BZA meeting.
Vernon Lambright’s petition for an oversized accessory building on property at 23 EMS D8 Lane, Syracuse, was approved. Lambright dropped a second petition for a residence accessory, adjusting his plan in order to meet the minimum setback.
Patrick McGlothin asked the board for permission to build an enclosed porch on a residence at 26 EMS B40E Lane, Leesburg. The petition was granted on the condition that the structure comply with all floodplain control ordinance requirements.
Duane Harman petitioned the board to allow a fourth sell-off to occur without being classified as a subdivision under the terms of the county’s subdivision control ordinance. The property is on the east side of CR 500W at the intersection of CR 700N in Prairie Township.
The petition was approved with the condition that a deed restriction is placed on the remaining acreage indicating it will have no further homes and only be used for agricultural purposes.
Joseph Shetler was granted a variance to build a residence addition at 211 S. Henry St., Milford. The addition will be within 10 feet of a south right of way.
A petition for a variance by Brennaman Home Rehab to allow a residence to remain as constructed and a shed to remain in place at 1944 Chapman Lake Drive, Warsaw, was approved as requested with the conditions that the company record the easement agreement with the owner to the southeast and supply a copy of the approved drainage board variance for the county’s file.
Chris Helfrich petitioned for a variance which would permit the construction of a deck 26 feet from the east right of way at 1020 E. Wellington Drive, Warsaw. The petition was approved with the condition that Helfrich provide a letter from the homeowners association indicating they support the proposal and recognize it is contrary to their recorded private restrictions.
Kira Courson was granted a variance that allows a second residence to remain in a barn at 13367 N. CR 100E, Milford. A previous owner had built the second residence. The request was granted on the condition that it not be rented out.
Luis Hernandez Marquez was granted an exception to allow him to operate a motorized vehicle sales, service and repair shop in a commercial district along U.S. 30 east of CR 325E, Warsaw.
Jennifer Carnes was granted a pair of petitions, one to allow a landscaping and snow plowing business with an oversized accessory building at 1916 S. Packerton Road, Warsaw, and the other to allow up to six non-family employees. The requests were approved with the condition that the property be reviewed in a year for compliance.
Will Sparkman was granted a petition to allow auto auctions the first four Saturdays of every month and to expand a parking area in an Industrial II district at 3805 S. Industrial Drive, Warsaw.
Joseph Salvo’s request for an exception to allow an oversized accessory building at 9845 N. Skyline Drive, Syracuse, was continued to the May 7 board meeting to allow Salvo time to speak with the homeowner’s association regarding the matter.
Bryan and Jennifer Lapel’s request for a variance on a new construction of an open deck at 8888 E. Hatchery Road, Syracuse, was denied. The board said new construction is required to meet the 5-foot setback.
