NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION
    The City of Nappanee Plan Commission will hold a Public Hearing Thursday, June 13, 2013 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.
    The purpose of this Hearing is to conduct a Public Hearing on Petition #01-13-PLN filed by Timothy P. Saylor of Innovative Communities, 18505 CR 28 Goshen, IN 46528                                     
     The petitioner is requesting a Preliminary Plat approval for a 22 lot subdivision to be known as Craftsman Village Phase I and Phase II.
Legal Description of Property:   
    Tract #1 A part of the Northwest Quarter of Section 6, Township 34 North, Range 5 East,  Jefferson Township, Kosciusko County, Indiana being more particularly described as follows:
    Commencing at a Harrison Monument marking the Northwest Corner of the Northwest Quarter of said Section 6; thence on an assumed bearing of South 00 Degrees 00 Minutes 00 Seconds East along the West Line of said Northwest Quarter of said Section 6 and along State Road No. 19, a distance of 1861.47 Feet to the Southwest corner of a parcel of land conveyed to Robert L. & Joyce A. Riley as described and recorded in the Office of the Recorder of Kosciusko County in Deed Record Volume 269, Page 353 and described in said Riley description as the Southwest corner of the North Half of said Northwest Quarter; Thence South 89 Degrees 21 minutes 50 Seconds East along the South line of said Riley parcel and along the North line of the Plat of John D. Metzler’s Subdivision on State Road 19 south of Nappanee, A Subdivision in Jefferson Township; said Plat being recorded in the Office of the Recorder of Kosciusko County,  Indiana in Plat Book 4, Page 92, a distance of 330.00 feet to a 5/8 inch rebar marking the Southeast Corner of said Riley Parcel, also being the Northwest corner of the Plat of Paddlebrook Pond Subdivision Section III, a Subdivision in Jefferson Township; said plat being recorded in the Office of the Recorder of Kosciusko County, Indiana in Plat Book 11, Page 28, The Point of Beginning of this Description; Thence continuing South  89 Degrees 21 Minutes 50 Seconds East along the North Line of said Paddlebrook Pond Subdivision Section III,  a distance of 1374.79 feet to a 5/8 inch rebar with a cap stamped Brads-Ko 0041 marking the Southwest corner of the Plat of Saemann Subdivision, a Subdivision in Jefferson Township; said Plat being recorded in the Office of the Recorder of Kosciusko County, Indiana in Plat Book 8 page 93; thence North 01 Degrees 09 Minutes 21 Seconds East along the West Line of said Saemann Subdivision, a distance of 346.78 feet to a 5/8 inch rebar with cap marked Brads-Ko 0041; Thence North 90 Degrees 00 Minutes 00 Seconds West, a distance of 912.0 feet;  Thence South 00 Degrees 00 Minutes 00 Second East, a distance of 1.30 feet; Thence North 90 Degree 00 Minutes 00 Second West, a distance of 135.00 feet; Thence South 00 Degrees 00 Minutes 00 Seconds East, a distance of 5.00 feet; Thence North 90 Degrees 00 Minutes 00 Seconds West, a distance of 111.70 feet; Thence North 90 Degrees 00 Minutes 00 Seconds West, a distance of 283.79 feet to a point on the  East line of a parcel of land conveyed to Merle Ross Holden as described and recorded in the Office of the Recorder of Kosciusko County in Instrument Number 2001090710; Thence south 00 Degrees 00 Minutes 00 Second East along the East Line of said Holden Parcel and the East Line of aforesaid Riley parcel, a distance of 213.44 feet to the Point of Beginning of this Description containing 9.949 acres, more or less, and being subject to all easements, restrictions and public rights of way of record.
    Legal Description: Tract #2: Beginning at the Southwest corner of Lot 4 in the Saemann Subdivision in Section 6, Township 34 North Range 5East, Jefferson Township, Kosciusko County, Indiana and recorded at Plat Book 8, Page 93, in the Office of the Recorder of Kosciusko County; thence South 90.00 0 feet 0 inches East a distance of 66.2 feet to the Northwest corner of Lot 5 in the Saemann Subdivision; thence South 0 degree 19 feet 13 inches East a distance of 200 feet to the Soputhwest corner of Lot 6 in the Saemann Subdivision; thence South 90 degree 0 feet 0 inches East a distance of 129 feet to the Southeast corner of Lot 6 in the Saemann Subdivision; thence South 0 degrees 19 feet 13 inches West a distance of 256.23 feet to a point on the South line of the said Saemann Subdivision; thence North 89 degrees 43 feet 54 inches West a distance of 195.28 feet to the Southwest corner of the said Saemann Subdivision; thence North 0 degrees 19 feet 40 inches East a distance of 455.31 feet tot the Southwest corner of Lot 4 in the Saemann Subdivision and the point of beginning. Containing 1.45 acres, more or less. Designated as an “Area Reserved for Retention Basin” on the recorded Plat of the Saemann Subdivision.
    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.
    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.

That is where our laws come from including building and zoning etc. That is also how they will TRY to take our guns but that would be suicide on their part and i would enjoy watching the blood spill on the evil doers side. Everyone get back to sports and your 1000 channels of nothing on television and get back to being programmed.
