NOTICE OF SHERIFF SALE - MF-00050 - KEAFFABER

NOTICE OF SHERIFF’S SALE
TO THE OWNERS OF THE WITHIN DESCRIBED REAL ESTATE
AND ALL INTERESTED PARTIES
    By virtue of a certified copy of a decree to me directed from the Clerk of Circuit Court of Kosciusko County, Indiana, in Cause No. 43C01-1303-MF-00050 wherein US Bank National Association as Trustee for the holders of Bear Stearns Asset Backed Securities I Trust 2006-IM1, Asset Backed Certificates Series 2006-IM1 was Plaintiff, and Carolyn K. Keaffaber; Danny D. Keaffaber; Runaway Bay Condominium Owners Association Inc., A/K/A Runaway Bay Phase III Condominium Owners Association; Robert Grabill; were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 25th day of March, 2014, at the hour of 10:00 AM or as soon thereafter as is possible, at 221 W. Main St., Warsaw, IN 46580, the fee simple of the whole body of Real Estate in Kosciusko County, Indiana.
    PARCEL I: Family Unit No. 39 in Runaway Bay Horizontal Property Regime, Section III, as recorded in Miscellaneous Record 51, as Page 102, in the Office of the Recorder of Kosciusko County, Indiana, under the date of July 16, 1973, being further identified as Unit 39 of Bldg. No. 7 and Parking and Storage Unit No. 39 as shown on the Site Development Plan of said Regime recorded on July 16, 1973, in Miscellaneous Record 51, at Page 103, and filed in Horizontal Property Plan File Number 5, in the Office of the Recorder of Kosciusko County, Indiana.
    PARCEL II:    An undivided 3.512% in and to the common areas and facilities as described in Declaration recorded the 16th day of July, 1973, Kosciusko County, Indiana, and Runaway Bay Horizontal Property Regime, Section III, Site Development Plan, filed for record in the Recorder's Office of Kosciusko County, Indiana, on July 16, 1973 in Horizontal Property Plan File Number 5, said Site Development Plan being also recorded July 16, 1973, in Miscellaneous Record 51, Page 103, in said Recorder's Office, as limited by said Declaration.
    ALSO, an undivided one seventy-seventh (1/77th) interest in the following Real Estate, in Kosciusko County, in the State of Indiana, to-wit:
    A tract of land in the South fractional Half of the Southwest fractional Quarter of Section 24, Township 34 North, Range 7 East, in Turkey Creek Township, Kosciusko County, Indiana, more particularly bounded and described as follows:
    Commencing at the Northeast corner of the Southeast Quarter of the Southwest fractional Quarter of Section 24; thence West along the centerline of the Eli Schock Road or alternate State Road 13 a distance of 482.5 feet; thence South 53 degrees 08 minutes West along the centerline of said road, a distance of 794.0 feet; thence South 21 degrees 20 minutes West along the centerline of said road a distance of 253.00 feet; thence North 68 degrees 40 minutes West a distance of 105.00 feet; thence South 21 degrees 20 minutes West a distance of 36.57 feet; thence South 56 degrees 25 minutes 37 seconds West a distance  of 69.57 feet; thence South 56 degrees 20 minutes West a distance of 111.0 feet; thence South 41 degrees 20 seconds West a distance of 74.00 feet to an iron pipe; thence North 48 degrees 40 minutes West along the Southwesterly line of Runaway Bay Horizontal Property Regime, Section II, as recorded in Miscellaneous Record 50, Page 121 in the County Recorder's Office, a distance of 130.00 feet to an iron pipe; thence North 33 degrees 40 minutes West along said Southwesterly line a distance of 66 feet more or less to the shore line of Lake Wawasee, said point being the point of beginning.  Thence South 33 degrees 40 minutes East along said Southwesterly line a distance of 11 feet more or less to an iron pipe; thence continuing South 33 degrees 40 minutes East along said Southwesterly line a distance of 55.06 feet to an iron pipe; thence South 48 degrees 40 minutes East along said Southwesterly line a distance of 79.95 feet to an iron pipe; thence South 41 degrees 18 minutes 20 seconds West a distance of 45.65 feet to an iron pipe; thence South 66 degrees 00 minutes 20 seconds West a distance of 77.34 feet to an iron pipe; thence North 24 degrees 10 minutes West along the Northeasterly line of Runaway Bay Horizontal Property Regime, Section III, a distance of 130.74 feet to an iron pipe; thence North 65 degrees 40 minutes West along said Northeasterly line 52 feet, more or less, to the shore line of Lake Wawasee; thence Northeasterly along the shore line of Lake Wawasee to the point of beginning; containing thereof 0.35 acres, more or less.
