KOSCIUSKO COUNTY AREA PLAN - MUNOZ

NOTICE OF PUBLIC HEARING
Notice is Hereby Given, that the Kosciusko County Area Plan Commission Shall Hold A Public Hearing on a Petition Filed by Gustavo Munoz Requesting an Amendment to the Kosciusko County Zoning Ordinance, to Reclassify Property from Commercial District to a Residential district,     The Following Real Estate, 010-108-012, 010-108-005, & 010-108-001 and Located on the S. Side US 30, East of Miller St. and Described As Follows, to Wit:     Parcel I: Lots Numbered One (1) and Two (2) in Conant and Moore's Addition to the Town of Pierceton, as recorded in Plat Book 1, page 106, in the Office of the Recorder of Kosciusko County, Indiana.
    Parcel II: A tract of land in the Southeast Quarter of Section 27, Township 32 North, Range 7 East, Kosciusko County, Indiana, more particularly described as follows: Beginning at an iron pipe marking the intersection of the North line of the Penn Central Railroad and an extension of the East line of Lot 1 in Conant and Moore's Addition to the Town of Pierceton, said point of beginning being situated 1663.7 feet (recorded 96 rods which equals 1584 feet) West of the East line of said Southeast Quarter; thence North 01º32' East (recorded North), along the East line of Lots 1 and 12 in said Addition, a distance of 386.14 feet (recorded 411.3 feet) to the South right-of-way line of U.S. Highway 30, the Northerly projection of the East line of said Lots 1 and 12 intersects the North line of said Southeast Quarter at a point situated 1664.0 feet (recorded 96 rods which equals 1584 feet) West of the Northeast corner of said Southeast Quarter; thence Southeasterly, on and along siad South right-of-way line, being defined by a regular curve to the left, having a radius of 6461.3 feet, an arc distance of 229.34 feet (recorded 260.0 feet) (the chord of which bears South 57º46'30" East, for a length of 229.33 feet) to an iron pipe found; thence South 29º00' West, a distance of 321.65 feet (recorded 321.5 feet) to an axle found on the North right-of-way line of the Penn Central Railroad; thence North 70º00' West, a distance of 51.5 feet to the place of beginning.
Also, the following described tract of land for the purpose of ingress and egress: beginning at the Northeast corner of the above-described tract; thence Southeasterly along the right-of-way of U.S. Highway #30, a distance of 50 feet; thence South 29 degrees 00 minutes West, a distace of 40 feet; thence Northeasterly and parallel to U.S. Highway #30, a distance of 50 feet; thence North 29 degrees 00 minutes East, a distance of 40 feet to the Place of Beginning.
    Parcel III: Part of Lots Numbered Eleven (11) and Twelve (12) in Conant and Moore's Addtion to the Town of Pierceton, being more particularly described as follows, to-wit: Beginning at an iron pin set at the Southeast corner of said Lot 12; thence North 01º32; East (adjoiner's deed bearing), on and along the East line of said Lot 12, a distance of 74.31 feet to a concrete right-of-way marker found at the point of intersection with the Southerly right-of-way line of U.S. Highway Number 30, thence Northwesterly, on and along said Southerly right-of-way ine, being defined by a regular curve to the right, having a radius of 6452.3 feet, an arc distance of 132.6 feet (the chord of which bears North 56º07'12" West for a length of 132.6 feet) to a concrete right-of-way marker found; thence North 78º48' West,  on and along said Southerly right-of-way line, a distance of 3.5 feet to an iron pin set at the point of intersection with the West right-of-way line of said Lot 11; thence South 01º32' West, on and along the West line of said Lot 11, a distance of 127.9 feet to an iron pin set at the Southwest corner of said Lot 11; thence South 79º37'30" East, on and along the South line of said Lot 11 and on and along the South line of said Lot 12, a distance of 116.9 feet to the point of beginning.
    This Change is requested to permit the Above Described Real Estate to be used for the Purpose of Residential Uses as Defined in the Kosciusko County Zoning Ordinance.
    This Hearing will be Held in the Commissioners Room in the Kosciusko County Court House on Wednesday, February 5, 2014 at 1:00 P.M.
    All Interested Persons are invited to attend to be heard. Written comments will be Considered if they are received in the Office of the Kosciusko County Planning Department, Court House, Warsaw, Indiana, No Later than 12:00 Noon on the Day of the Hearing.
