NOTICE OF SHERIFF SALE - MF-202 - HALL

NOTICE OF SHERIFF’S SALE
TO THE OWNERS OF THE WITHIN DESCRIBED REAL ESTATE
AND ALL INTERESTED PARTIES
    By virtue of a certified copy of a decree to me directed from the Clerk of the Superior Court of Kosciusko County, Indiana, in Cause No. 43D03-1208-MF-202, wherein PNC Bank, National Association  was plaintiff and Rocky L. Hall, et. al., were the defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 17th day of December, 2013, at the hour of 10:00 a.m. or  as soon thereafter as is possible, at 221 West Main Street, Warsaw IN  46580, the fee simple of the whole body of real estate in Kosciusko County, Indiana:
     Indiana: Tract Number 1:
    Commencing at a point fourteen (14) rods and thirteen (13) feet south of the northwest corner of Section Numbered Two (2),Township Thirty-Four (34) North, Range Five (5) East, running thence South seven (7) rods thence East seven and one-half (7 V2 ) rods; thence north seven (7) rods; thence West seven and one-half (7 V2 ); to the place of beginning, excepting therefrom a strip of land thirty (30) feet wide off and from the North end of the above described tract, heretofore deeded to the Baltimore and Ohio Railroad Company.
    The above described tract, after exception, being more accurately described as follows, to-wit:
    Commencing at the northwest corner of Section 2, Township 34 North, Range 5 East, Jefferson Township, Kosciusko County, Indiana; thence due South a distance of 274.0 feet to the point of beginning of this description; thence South 84 degrees 15 minutes 30 seconds East (parallel with above mentioned railroad's existing tracts), a distance of 124.37 feet; thence due South a distance of 73.06 feet; thence due West, a distance of 123.75 feet; thence due North, a distance of 85.5 feet to the aforementioned  point of beginning.
    Tract Number 2:
    Commencing at the northwest corner of Section 2, Township 34 North, Range 5 East, Jefferson Township, Kosciusko County, Indiana; thence due South a distance of 359.5 feet to the point of beginning of this description; thence due East, a distance of 123.75 feet; thence due South, a distance of 36.5 feet; thence due West, a distance of 123.75 feet; thence due North, a distance of 36.5 feet to the aforementioned point of beginning.
    Tract Number 3:
    The North 10 feet by parallel lines of the following described tract:
    Commencing at a point 24 rods South of the Northwest corner of Section 2, Township 34 North, Range 5 East, and running thence East 8 rods thence South 10 rods thence West 8 rods; thence North 10 rods to the place of beginning.
    Tract Number 4:
    A tract of land in the Northwest Quarter of Section 2, Township 34 North, Range 5 East, Kosciusko County, Indiana, and more particularly described as:
    Commencing at the Northwest corner of said Northwest Quarter, said point marked by an iron pin; thence South 00 degrees 00 minutes 00 seconds West (assumed bearing),along the West line of said Northwest Quarter and within the right of way of county Road 400 West,274.00 feet to a P.K. nail on the South right of way of the Baltimore and Ohio Railroad; thence South 84 degrees 15 minutes 30 seconds East along said South right of way,124.37 feet to an iron pin marking the Northeast corner of the property of Ronald and Mary Saffron (DSR 92-09-0467)  for a true Point of Beginning; thence continuing South 84 degrees 15 minutes 30 seconds East, along said South right of way,118.85 feet to a P.K. nail; thence South 00 degrees West, parallel with the West line of the Northwest Quarter of Section 2,107.62 feet to an iron pin thence South 90 degrees 00 minutes 00 seconds West, 110.0 feet to an iron pin marking the Southeast corner of said
    Daffron property; thence North 00 degrees 00 minutes 00 seconds East parallel with the West line of said Northwest Quarter, 10.00 feet to an iron pin; thence South 90 degrees 00 minutes 00 seconds West, 8.25 feet to an iron pin; thence North 00 degrees 00 minutes 00 seconds East, parallel with the West line of said Northwest Quarter, 109.56 feet to the point of beginning, containing 0.307 acres, more or less.

    Parcel No. 43-02-02-400-018.000-012
    Together with rents, issues, income, and profits thereof, said sale will be made without relief from valuation or appraisement laws.
