REMOVAL OF UNSAFE BUILDING - KEMNITZ

NOTICE DEMANDING PAYMENT TO JEROME KEMNITZ AND KIMBERLY KEMNITZ, Y.B.M.C. CORPORATION, AND ALSO TO ANY AND ALL OWNERS OR HOLDERS OF ANY INTEREST IN REAL PROPERTY COMMONLY KNOWN AS 7351 N. STATE RD. 13, NORTH WEBSTER, INDIANA 46555

COUNTY OF KOSCIUSKO
    Pursuant to Indiana Code 36-7-9-1 et seq., as adopted by Kosciusko County Ordinance 11-11-22-001, Jerome Kemnitz and Kimberly Kemnitz were ordered on January 8, 2013 to demolish and remove the unsafe building located on real property situate in Kosciusko County, Indiana, which real property is commonly known as 7351 North State Road 13, North Webster, Indiana, and legally described as follows:  
    A tract of land situate in the Southwest Quarter of Section 3, Township 33 North, Range 7 East, more particularly described as follows, to-wit:
    To find the Point of Beginning, start at a point where the East side of the right-of-way of Old State Road 13 and the West side of the right-of-way of New 13 intersect; thence measure in a Northerly direction, 1345 feet along the West side of the right-of-way of New State Road 13; from this Point of Beginning, running thence North along the West right-of-way of New State Road 13 for 40 feet, more or less, to a tract owned by Clarence Lewallen, et al; thence West 100 feet; thence South 40 feet, more or less, to a point due West of the Place of Beginning; thence East 100 feet to the Place of Beginning.
    That the said order was affirmed by the hearing authority on February 28, 2013, but that the order was not complied with, and that, accordingly, a contract was let at public bid for the removal of the said unsafe building.  That more than fifteen (15) days have elapsed since completion of the work and that costs in the amount of Three Thousand Four Hundred and Ninety-Nine Dollars and Zero Cents ($3,499.00) remain unpaid.  This notice is to demand payment in full of this amount within thirty (30) days.  If payment in full is not made within the allowed time, then the unpaid amount may be added to the tax duplicate of the affected property as a special assessment.
