Slip-And-Fall Suit Filed

A Winona Lake minor and his father recently filed a lawsuit against Hacienda Mexican Restaurant in Warsaw.
The minor, Chase E. Townsend, and his father, Don Townsend, are suing the restaurant for negligence because Chase allegedly suffered an injury when he slipped on a patch of ice outside the restaurant.
The suit states that Chase intended to eat lunch at the restaurant Feb. 9, 2008, and that as he "approached the front entrance of the restaurant, he encountered an extremely slick patch of ice on the sidewalk."
The suit continues, "...the plaintiff's left foot slid on the ice and he severely twisted his ankle."
The suit alleges that the restaurant "failed to maintain its sidewalk area in a manner that provides a safe environment for customers who are entering and leaving the restaurant" and "that the (restaurant's) breach of its duty to provide customers safe ingress and egress was the direct cause of (Chase Townsend's) fall on Feb. 9, 2008."
The Townsends seek $29,000 for medical expenses as well as damages for pain and suffering, future medical expenses and permanency of injury.
The plaintiffs request a trial by jury in Kosciusko Circuit Court.
